My name is David Mawdsley. I am a public access barrister specialising in unfair and constructive dismissal cases. I was called to the Bar in 1995.
Unfair dismissal can arise in a variety of situations. For example, you may have been unfairly selected for redundancy or been the victim of an unfair disciplinary procedure. You may have been discriminated against or victimised for having done a 'protected act' such as reporting sexual harassment.
Constructive dismissal arises when an employee resigns because of the way they have been treated. If an Employment Tribunal finds that the employer's conduct was so unfair as to repudiate the contract of employment, the employee will be deemed to have been constructively dismissed.
Most claims settle without either party having to attend a tribunal, although a claimant often has to issue proceedings before a settlement is reached. Settlements can amount to thousands of pounds and include a positive reference to help relaunch a claimant's career.
